Comprehensive Terms of Service

Effective Date: December 30, 2025

1. Introduction & Acceptance of Terms

This User Agreement (“Agreement”) is a contract between you (“User,” “you,” or “your”) and asian-freelancers.com (“Platform,” “we,” “us,” or “our”).

  • Binding Agreement: By clicking “Sign Up,” “I Agree,” or by simply accessing the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, including the Privacy Policy and Fee Schedule.
  • Modification: We reserve the right to modify these terms at any time. Significant changes will be communicated via email or site banner. Your continued use after such changes constitutes acceptance.

2. Account Eligibility & Registration

2.1 Eligibility

To use our Services, you must:

  • Be an individual at least 18 years of age or a legal business entity in good standing.
  • Be able to form legally binding contracts.
  • Not be barred from using the platform by the laws of your jurisdiction or any international sanctions.

2.2 Account Types

Users may register as a Client (seeking services) or a Freelancer (offering services). You may operate both a Client and a Freelancer profile under one account, provided all information is accurate.

2.3 Identity Verification

We reserve the right, but do not have the obligation, to verify your identity. This may include requesting government-issued ID, video verification, or proof of address. False information will lead to immediate account permanent suspension.

3. Relationship between Users and the Platform

3.1 Independence

Asian-freelancers.com is a marketplace only. We do not provide freelancing services, nor do we employ Freelancers.

  • No Agency: No agency, partnership, joint venture, or employer-employee relationship is created between the Platform and any User.
  • Service Contracts: When a Client hires a Freelancer, they enter into a Service Contract directly with each other. The Platform is not a party to this contract.

3.2 Non-Circumvention (The “Stay on Platform” Rule)

To protect the integrity of the marketplace, Users agree to communicate and process all payments exclusively through asian-freelancers.com for a period of 24 months from the date they first meet on the Platform.

  • Asking for direct PayPal, bank transfers, or sharing personal contact info (WhatsApp, Telegram, Email) before a contract is started is a strict violation and may result in a permanent ban.

4. Payments, Escrow, and Fees

4.1 Platform Fees

  • Freelancer Fees: The Platform charges a service fee (e.g., 10-20%) on all earnings.
  • Client Fees: A transaction or processing fee may be applied to each payment.

4.2 Milestone & Escrow System

For fixed-price projects, the Platform uses a Milestone system.

  • Funding: The Client funds a Milestone. The money is held by the Platform (Escrow).
  • Release: Once the work is submitted and approved by the Client, the funds are released to the Freelancer.
  • Automatic Release: If a Client does not approve or dispute a submission within 14 days, the Platform may automatically release the funds.

4.3 Taxes

Users are solely responsible for determining their tax obligations (VAT, Income Tax, etc.) in their respective countries. The Platform does not withhold taxes unless required by law.

5. Intellectual Property (IP) Rights

5.1 Ownership of Work Product

Upon full payment by the Client, the Freelancer transfers all ownership rights, including copyrights and intellectual property, to the Client, unless otherwise agreed in writing.

5.2 Platform License

By posting content (portfolios, job descriptions, reviews), you grant asian-freelancers.com a worldwide, royalty-free license to use, host, and display that content for marketing and operational purposes.

6. Prohibited Activities

Users are strictly prohibited from:

  • Academic Dishonesty: Completing homework, exams, or university assignments for others.
  • Fraudulent Reviews: Manipulating feedback systems by buying/selling fake reviews.
  • Illegal Services: Offering services that violate local or international laws (e.g., hacking, selling stolen data).
  • Multiple Accounts: Creating more than one account per person without prior written consent.

7. Dispute Resolution & Arbitration

7.1 Internal Dispute Resolution

If a conflict arises regarding a Milestone, Users must first use the Platform’s Dispute Center.

  • We will act as a neutral mediator.
  • Both parties agree to provide evidence (chat logs, files, screenshots) within the timeframe requested.

7.2 Final Decision

You acknowledge that the Platform’s decision in a dispute is final and binding for the purpose of releasing Escrow funds.

8. Limitation of Liability & Indemnity

  • As-Is Basis: The Platform is provided “as is” without warranties of any kind.
  • No Liability: In no event shall asian-freelancers.com be liable for lost profits, loss of data, or any indirect damages resulting from a project failure or user conduct.
  • Indemnification: You agree to indemnify and hold the Platform harmless from any claims, damages, or legal fees arising from your breach of these Terms.

9. Termination

  • Termination by User: You may close your account at any time, provided you have no active contracts or outstanding debts.
  • Termination by Platform: We may suspend or terminate your account instantly if we suspect fraud, breach of terms, or risk to the community.
